@linkz101 No, she didn’t. First of all, she said that the winning bid received what was in the photos but it was impossible to tell that she was referring to the photos themselves as being the content. Her intent was to deliberately mislead people into believing that the photos were not what was being sold as there was obviously no mention in the ad title that only photos of cellphones were being sold. Second, the description in the ad gave the weight for the phones not the pics. Slam dunk.

@duckbuck12 i didnt know about the return policy so though the ad is legit that would be true. so that i do agree with. I just think that the person in the court shouldn’t be rewarded for not reading the add beforehand. That does not mean however that i think the scammer should be able to do this.
@linkz101 you miss the point, the purpose of the ad is to mislead people, are you honestly saying that you would buy a picture of a phone for $250? of course not, therefore its fraudulant, and she loses. And let’s just assume that the ad is legit, you still have a return policy, she refused to return the money (return polic is there to protect the consumer) so either way she has to give the money back, you dig?
the ebay seller should have won this case…it said clearly 2 photos…she sold exactly what she said

When you’re selling an item for a couple hundred dollars and you claim you wrote “photo only” do you honestly expect that person to actually believe that you’re only showing selling them a photo of a product instead of the product? The blonde wanted to be a smartass with “photo only” comment but ended up a dumbass.
